Crece rechazo a la reforma 
Representantes estudiantiles manifestaron que han dado su cuota de lucha en el tema de la reforma constitucional, e invitaron a todos los sectores de la vida nacional que adversan dichos cambios a pronunciarse al respecto y no esperar por la actuación de los jóvenes.David Smolansky, representante estudiantil de la Universidad Católica Andrés Bello (UCAB), augura resultados positivos en la movilización estudiantil hasta el Consejo Nacional Electoral. “Hemos hablado que está marcha es la más importante que se vaya hacer en este año, desde que surgió el movimiento estudiantil el 28 de mayo”.
Smolansky manifestó que no se siente intimidado por las declaraciones del ministro del Interior y Justicia, Pedro Carreño, pues “cada vez que el Gobierno, que alguno de estos voceros da una de estas declaraciones controversiales, más ganas le da al estudiante de salir a protestar, no se les olviden que somos jóvenes y como tal, como estudiantes que somos, esta irreverencia que tiene el joven como tal que no le gusta que le cercenen sus derechos”.
El joven recalcó que los estudiantes tienen una cuota, pero la población no debe recargarse en ellos, sino que cada uno debe tener su participación en la lucha. “Un país se construye cuando todos los sectores de la sociedad asume su rol y contribuye para un mejor país”.

Por su parte, Ricardo Sánchez, secretario general de la Federación de Centros de la UCV, indicó que “el problema de la reforma no afecta solamente a los estudiantes, de allí la lucha para frenarla, se detenga esta posición arbitraria y autoritaria”.El representante ucevista dijo que se está cuadrando con los estudiantes a nivel nacional su traslado a la capital, pero señaló que el principal movimiento se debería dar desde la ciudad de Caracas, con el fin de lograr una máxima convocatoria hacia el CNE el día jueves.
“No es un problema de votar o no votar, el problema es que se está violando el derecho a la información, creemos que no hemos tenido tiempo para debatir la reforma constitucional”, dijo.
Cuestionó el poco conocimiento de las personas de la reforma constitucional y que los diputados sigan realizando cambios en la Carta Magna.
Suprimen la ley de estados de excepción
Al cierre de esta edición, los diputados sólo habían aprobado la tercera disposición del proyecto de reforma constitucional del Presidente. El mencionado precepto está referido a la "elección de los y las representantes indígenas a la Asamblea Nacional y a los Consejos Legislativos estatales y municipales".
Los legisladores del PSUV destacaron como uno de los puntos positivos de esta disposición el hecho de que se fija lo siguiente: "Para los efectos de la representación indígena al Consejo Legislativo y a los concejos municipales con población indígena, se tomará el último censo oficial de la Oficina Central de Estadísticas e Informática, y las elecciones se realizarán de acuerdo con las normas y requisitos aquí establecidos".
Los parlamentarios también agregaron una disposición transitoria más a las once originales. A través de este nuevo precepto, suprimieron la Ley Orgánica de los Estados de Excepción.
La presidenta del Poder Legislativo, Cilia Flores, ratificó que tan pronto sancionen la propuesta redactada por el mandatario, Hugo Chávez, la llevarán hasta el Consejo Nacional Electoral. Este documento se consignará el viernes en el CNE para activar el artículo 344 del texto fundamental vigente.
La norma en cuestión señala: "El proyecto de reforma constitucional aprobado por la Asamblea Nacional se someterá a referendo dentro de los treinta días siguientes a su sanción". De esta forma, la consulta popular se realizará el domingo 2 de diciembre.
Los legisladores, que se sumarán a la campaña por el Sí, estudian agregar más artículos al proyecto.

Asamblea debe aprobar 15 leyes para adecuarlas a la reforma
A las 11 disposiciones transitorias inicialmente previstas en el proyecto de reforma constitucional, la plenaria de la Asamblea Nacional acordó sumarle 4 nuevas, para un total de 15 aprobadas este martes, luego de unas cuatro horas de debate. Adicionalmente, fueron incorporadas una derogatoria y una final.
La disposición 1° prevé que el Parlamento, a partir de la entrada en vigencia de la reforma, deberá legislar sobre un cuerpo de temas prioritarios contemplados en quince leyes. Entre ellas, la de Poder Popular, Promoción de la Economía Socialista, Banco Central, Código Penal, Poder Municipal, Hidrocarburos, Hidrocarburos Gaseosos, Sistema de Justicia, Seguridad Social, y Educación.
Ese grupo de leyes incluirá también la Orgánica del Trabajo a fin de retomar la retroactividad de las prestaciones sociales y aplicar, progresivamente, la nueva jornada laboral.
La disposición 2° devuelve la investidura a los diputados electos en 2005 que están hoy ocupando cargos públicos.
Las disposiciones 3°, 4°, 5°, 6°, 7° y 8° son, con actualizaciones puntuales, las mismas formuladas al final de la Carta Magna de 1999 en los ordinales 7°, 8°, 10°, 12°, 15° y 18°, y que, pese a su mandato de ocho años de vigencia, el Poder Legislativo aún no le ha dado cumplimiento.
La aprobación de la 9° prevé que el tránsito hacia el modelo de economía socialista será hecho mediante la aprobación de decretos ley, hasta que sea desarrollado lo previsto en el artículo 112 de la Constitución.
La 10° se refiere a la modificación del situado constitucional. La 11° permite el financiamiento temporal al Poder Popular con el Fondo Nacional de los Consejos Comunales. Según la 12°, las competencias de la Alcaldía Metropolitana serán asumidas por el Distrito Federal. La 13° establece un año para la transferencia de competencias al Poder Nacional.
Mediante la 14° el período presidencial de siete años comenzará a regir en 2013 y la 15° se refiere a la participación del Poder Popular en la elección de órganos de control. La disposición derogaria deja sin efecto la Ley sobre Estados de Excepción. La disposición última prevé que la reforma entrará en vigencia el día de su publicación en la Gaceta Oficial, después de que sea aprobada en referendo popular.

Por considerar que la Constitución puede convertirse "en una fuente de fractura social y de serios conflictos", representantes de diez universidades del país y decenas de catedráticos solicitaron a la Asamblea Nacional que suspenda el trámite de la reforma constitucional planteada por el presidente Hugo Chávez e inmediatamente abra un proceso de diálogo con los diversos sectores del país, para alcanzar un consenso entorno a la revisión de la Carta Magna.
Los decanos de las facultades de Derecho de las universidades Central de Venezuela (UCV), Católica Andrés Bello (UCAB), Monteávila (UMA), de Carabobo (UC), José María Vargas, Arturo Michelena, Metropolitana (Unimet), de Yacambú, José Antonio Páez y Católica del Táchira (UCAT); así como tres miembros de la Academia de Ciencias Políticas y Sociales y 14 profesores de Derecho Constitucional rechazaron la propuesta del mandatario, así como las modificaciones realizadas posteriormente por el Parlamento, a las cuales calificaron de "jurídicamente inaceptables".
En rueda de prensa celebrada ayer, en la extensión de la UCAB en Chacao, el representante de esa casa de estudios, Jesús María Casal, leyó el documento en el cual se afirma: "La Constitución debe ser un punto de encuentro entre corrientes políticas diversas e incluso contrarias, no una plataforma normativa para la entronización de las propias concepciones y la exclusión de los demás. Si la Constitución se identifica con la ideología de un sector político-partidista, pierde su apertura a otras formas de pensar y de entender la acción política y las relaciones de la persona con la sociedad".
Aunque no hicieron ningún llamado a aprobar o rechazar la reforma, los expertos advirtieron que ésta contiene varias disposiciones que son "regresivas" en materia de derechos humanos.
Seguidamente señalaron que el planteamiento dificulta la activación de mecanismos de participación ciudadana (referendos) y condiciona a los medios de participación a la construcción del socialismo. Asimismo recordaron que los derechos sobre creaciones científicas, artísticas o humanísticas quedan desprotegidas y que se suprime el derecho de toda persona a dedicarse a la actividad económica de su preferencia y debilita los límites y controles institucionales de los estados de excepción.
Sobre este último asunto, Casal agregó: "La Asamblea tiene que darle al país una explicación de por qué nos quieren acotar nuestros derechos fundamentales. ¿Qué es lo que se pretende? ¿Se pretende volver a la figura de suspensión de garantías?"
Interrogado sobre lo que ocurriría de aprobarse en referendo la iniciativa, dijo: "Sería lamentable que alguien pudiera renunciar a sus derechos".
Los catedráticos rechazaron las modificaciones realizadas para incorporar la "nueva geometría del poder", pues le otorga al jefe del Estado la potestad de crear y suprimir las regiones marítimas, las ciudades federales, los distritos funcionales, territorios federales y las demás nuevas estructuras de político-administrativas; en detrimento de las facultades de los gobiernos regionales y municipales.
"La descentralización es abandonada como política nacional", alertaron los especialistas en Derecho, quienes también denunciaron que la reforma menoscaba la "ya precaria división de poderes (...), al preverse la remoción de los magistrados del Tribunal Supremo de Justicia por una simple mayoría de los integrantes de la Asamblea".
Los representantes de las universidades y de las academias reconocieron que los planteamientos de la reforma, como la reducción de la jornada laboral y la creación de un fondo de protección social para los trabajadores independientes, son positivos.
No obstante, aclararon que todos esos planteamientos pueden y ya debían haberse puesto en marcha, gracias a iniciativas legales que ha debido adoptar el Parlamento.

La cita obligada de todos los domingos a las 11:00 am, cambiará. A partir de la próxima semana, a la hora acostumbrada para el inicio del ¡Aló Presidente!, los venezolanos podrán sintonizar los debates que promoverá el Poder Electoral sobre la reforma constitucional.
A pesar de que los detalles técnicos de los cuatro espacios no han sido concretados, los rectores del CNE presentaron a consideración de los partidos políticos formatos de debates de una hora máxima de duración, en que cada invitado -uno por el bloque del "SI" y otro por el Bloque del "NO"- dispondrán de tres minutos para exponer sus argumentos.
Los integrantes de los bloques tendrán autonomía para definir a las personas que los representarán en cada debate, así como los temas que deberán discutirse en cada emisión.
¿Quiénes moderarán los espacios? A sugerencia de la Dirección de Información y Relaciones del CNE, se le propuso a los partidos políticos el nombre de cuatro periodistas, para cada una de las emisiones previstas. Los nombres sugeridos son: Ernesto Villegas, Eduardo Rodríguez, Tania Vegas y Elvia Gómez. No obstante, su participación depende de la aprobación definitiva de los partidos, que aspiran a que los moderadores actúen "de bajo perfil", y que realicen preguntas previamente acordadas con los participantes en la diatriba. Especialmente los partidos de oposición objetan la posibilidad que los moderadores de los debates puedan "improvisar" interrogantes.
Un riguroso instructivo será el que guíe la intervención de los representantes de los bloques por el NO y el SI.
En el borrador de las normas para regular los debates se prohíbe que los panelistas se insulten o agredan verbalmente durante la transmisión del programa o que empleen consignas de campaña.
Aunque una de las principales peticiones de los partidos de oposición para garantizar el equilibrio informativo está referido a la promoción de debates televisados, los representantes del MAS, Copei, Acción Democrática, Un Nuevo Tiempo, y Primero Justicia, exigieron a los rectores Vicente Díaz y Germán Yépez aumentar a seis u ocho transmisiones la confrontación entre los representantes de los dos bloques del referendo.
La reglas definitivas de los debates se conocerán el lunes, cuando los representantes de los partidos vuelvan a reunirse con los rectores del Poder Electoral.

"La reforma constitucional que se quiere aprobar representa nuevas bases para la vida social, la mayor parte de las cuales contradicen los derechos humanos fundamentales", señaló el presidente del Consejo Nacional de Laicos (CNL), Mario González Casado, quien agregó que aceptar los contenidos y el procedimiento de la propuesta significaría "legitimar la violación de principios y estructuras vigentes en el texto fundamental".
Las palabras de González Casado forman parte de las consideraciones que el CNL hace sobre el proyecto presidencial de cambio constitucional y en respuesta a los ataques que contra los obispos venezolanos han realizado diferentes personeros del Gobierno, luego de la publicación del documento de la Conferencia Episcopal en el que se califica a la reforma de "moralmente inaceptable".
Señaló que la asociación que representa a un número importante de venezolanos que están en movimientos apostólicos, trabajan en parroquias, colegios y diversas instancias eclesiales, han querido pronunciarse para expresar su total solidaridad con lo que los obispos han señalado. "Pensamos que ese proyecto de reforma no se puede aceptar porque contradice derechos humanos que son inviolables".
En rueda de prensa hecha en la sede de la Conferencia Episcopal, González Casado invitó a los católicos y a todas las personas de buena voluntad a orar y reflexionar sobre la propuesta, al tiempo que les exhortó a "fijar posición, a la luz de los principios fundamentales para toda la sociedad, sin menoscabo del deber insoslayable que tenemos de ser promotores de justicia, reconciliación y paz".
Propuesta confunde los conceptos de Estado y Gobierno
Los obispos lo que han hecho "es alertar al pueblo de lo que va a pasar luego del 2 de diciembre. Si no se avispan y no abren los ojos, después se irá todo el mundo a llorar al monte, porque ahí no habrá más recursos" expresó el arzobispo de Coro, monseñor Roberto Lücker, en respuesta a los cuestionamientos que personajes del Gobierno y algunos sacerdotes oficialistas han realizado en contra de los prelados luego de la publicación del pronunciamiento de la Conferencia Episcopal Venezolana que calificó el proyecto de "moralmente inaceptable".
En rueda de prensa, Lückert indicó que el Gobierno, lejos de responder a las críticas con argumentos, lo que hace es "descalificar con la intención de meter miedo".
Subrayó que las modificaciones planteadas transforman "a un país democrático; a una república bolivariana democrática, pluralista, federativa, protagónica y participativa, como establece el preámbulo del texto vigente, en un Estado socialista".
En ese sentido, el segundo vicepresidente de la CEV explicó que uno de los notables errores del Gobierno en la propuesta es confundir los conceptos de Estado y Gobierno.
"Es contradictorio que la propuesta plantee cambiar un Estado federal y democrático, por un estado socialista dejando de lado el federalismo que tanto defendió el oficialismo al inicio de la revolución".
Para Lückert es una falta de respeto el que se diga que la Constitución Nacional va a ser roja rojita. Aclaró que "no se pueden imponer las cosas por la fuerza, menos a un país que lleva años de democracia".
